The travel contract is concluded between the booking party and Sensational Adventures. All Bookings can be done in writing, on Telephone or verbally. Sensational Adventures will immediately confirm any booking whether made verbally or by telephone or in writing.

As a condition of booking, you must provide the information requested by us with regard to any booking. If you fail to supply information required by Sensational Adventures, you will be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by us, We reserve the right to treat your booking (or the relevant component of your booking) as canceled and levy any cancellation fees.We will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.

Even in urgent cases, information regarding the names of the travelers and their whereabouts will not be provided to third parties unless the traveler has explicitly requested an information provision.

A deposit of 40% of the total tour price is required at the time of booking a tour. The remainder of the total quoted tour price is due NOT LATER THAN 60 DAYS (FOR GROUP TOURS) before the departure date. This is to enable us to book rooms and transport in good time as well as adequate time for ensuring that all the elements of the tour are in place in good time.

The confirmation sent by Sensational Adventures Tours will contain details of the final payment required for any booking.

If full payment is not received by the applicable due date without any prior communication, Sensational Adventures may, at its sole discretion, change the rate payable for the booking, or treat the booking as canceled and retain the deposit paid on booking as a cancellation fee. If for any product or service booked, payment terms differ from those outlined in this section, the applicable terms will be communicated to you prior to booking and will also be detailed on the applicable invoice.

We are not responsible for any charges levied by third parties or financial institutions and payable by you as a result of payment transactions and will not refund or return any fees charged by third parties or financial institutions in connection with payments made by you to Sensational Adventures.

Should a reservation be canceled or a number of days booked reduced or the number of guests reduced the following charges will apply.

Cancellations received sixty days or less prior to departure will be subject to the following forfeit fees:

60-30 days, 40% of tour cost.

14 -30 days, 60% of tour cost.

Less than 14 days, 100% of tour cost.

No refunds are given for: lost travel time or substitution of facilities and/or accommodations; itineraries amended after departure; not appearing for any accommodation, tour, game viewing or other booked activities; and/or cutting short the booked itinerary for any reason.

Departure date for a Tour offered by the Sensational Adventures will become a guaranteed departure when at least one booking secured by a valid deposit has been made on that departure.

Sensational Adventures guarantees that all scheduled Tour departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonably itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure.

If a Tour is canceled by the Tour Operator before the date of departure for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from the Tour Operator:

(a) A substitute Tour of equivalent or superior value; or

(b) A substitute Tour of lesser value if no tour of equivalent or superior value is reasonably available and to recover from the Tour Operator the difference in price between the price of the Tour originally purchased and the substitute Tour; or

(c) A full refund of all monies paid for the canceled Tour.

We are not responsible for any incidental expenses or consequential losses that you incur as a result of the canceled booking including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, the Tour Operator reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour as described cannot be provided after departure, the Tour Operator will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, the Tour Operator may provide you with a refund for unused products or services as determined in its discretion.

Government-imposed taxes such as airport departure/arrival taxes/security taxes may not be included in our package cost. Tips to driver-guides, escorts, On-Site guides, Hotel staff, etc. is not included either and are at your discretion. During certain seasons certain suppliers may impose a surcharge on their products which we will notify you well in advance.

The published price of the Tour and any products or services offered by Sensational Adventures is subject to change at any time, before or after booking confirmation, up to 30 days before departure. Tours are priced and advertised exclusive of applicable sales taxes.

After a confirmation invoice has been issued by the Tour Operator, the Tour Operator reserves the right to impose surcharges on any products or services booked for reasons arising from increases in transportation costs, fuel costs, dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airport charges, local operator costs, currency and exchange fluctuations, increases in taxes, or government action which impacts the price of the applicable products or services; Provided, however, the Tour Operator will only do so where the increase in question is greater than 2% of the original price paid for the products or services (excluding add-ons, insurance, and taxes).

Upon learning of the necessity to impose a surcharge in accordance with this section Sensational Adventures will provide notice to you as soon as reasonably possible.

Where the increase in price is greater than 2% of the original price of the applicable products or services (excluding add-ons, insurance, and taxes), you may choose to either:

(a) Cancel the applicable booking without incurring any penalty; or

(b) Accept the change in price.

You must notify the Tour Operator in writing of your choice within 14 days of receipt of notice of the increase or you will be deemed to have accepted the price change and will be liable for payment of the increase.

From time-to-time, the Tour Operator may offer reduced pricing on certain products or services. The reduced pricing applies only to new bookings. Bookings, where payment of at least a deposit has been received by us, are not entitled to a reduction.

AIRFARE- Tour prices do not include international or other airfare unless expressly mentioned in the Tour’s descriptions. The Tour Operator will quote the best price available for the travel dates requested at the time the quote is prepared. Quotes provide an estimate only and are not a firm price commitment by us or the applicable air carrier(s).

The Tour Operator acts only as a sales agent for the applicable air carrier and the air carrier terms and conditions apply to the purchase and use of the air travel ticket. Please consult the air carrier’s applicable terms and conditions and conditions of carriage for complete information including applicable cancellation terms. The Tour Operator is not responsible for changes in air itineraries or flight times and does not provide advice or alerts regarding air travel tickets, flight status or delays.

“Optional Extras” refers to any activity, transportation; meal, product or service not expressly included in the Tour itinerary or price of the Tour and do not form part of the Tour. You agree that any assistance was given by the Sensational Adventures representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and the Tour Operator makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of the Sensational Adventures regarding any Optional Extras. You release Sensational Adventures from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.

All dates, itineraries, and prices of Tours are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms.

All quoted tours and Safari prices include accommodation based on per person sharing Double or Twin. There is however a supplement for single occupancy upon request. Easter and Christmas holiday supplements may be applicable in some hotels and are payable by the client if not quoted in the tour cost.

NOTE; Clients will not be allowed to check-in or out by hotels, lodges, Camps and other accommodations if they have not cleared the total amounts of any booking.

Meals are included in the tour price as stated in the itinerary, FB=Full board, B=Breakfast, L=Lunch, and D=Dinner.

Special meal arrangements can be made upon request at extra cost.

Sensational Adventures, its Agents and Employees give notice that they act only as agent for the contractors and suppliers providing means of transportation and/or all related travel services. It, therefore, assumes no responsibility whatsoever for injury, personal illness, loss or damage clients are therefore advised to obtain travel insurance for the entire duration of travel.

We strongly recommend you protect yourself with a short-term traveler’s insurance policy to cover baggage loss, accident, medical emergencies, and trip cancellation, delays, and other unforeseen circumstances. It is your responsibility to ensure that the insurance covers all your activities during your holiday, for example, water sports, riding tours, snow scooter tours, and winter sports. Please read your policy carefully and take it with you on your holiday.

A change in the person of the traveler is possible if the replacing person meets all conditions regarding participation.

Where the customer is prevented from proceeding with the package, he may transfer his booking to another person. The tour operator must be informed about the transfer within a reasonable period before the departure date. The tour operator may notify a specific period in advance. The transferring party and the replacing person will be jointly liable for both the unbalanced remuneration and the additional costs arising from the transfer.

It is your responsibility to obtain information and to have in your possession all the required documentation and identification required for entry, departure, and travel to each country or region. This includes a valid passport and all travel documents required by the relevant governmental authorities including all visas, permits, and certificates (including but not limited to vaccination or medical certificates) and insurance policies.

You agree that you are responsible for the full amount of any loss or expense incurred by the Tour Operator that is a direct result of your failure to secure or be in possession of proper travel documentation.

You accept full responsibility for obtaining all such documents, visas, and permits prior to the start of the Tour, and you are solely responsible for the full amount of costs incurred as a result of missing or defective documentation.

The Tour Operator will collect your personal information to deliver the Tour and any products or services booked. The Tour Operator collects, uses and discloses only that information reasonably required to enable them and their Third Party Suppliers to provide the particular Tour, products and/or services that you have requested. By submitting any personal information to the Tour Operator, you indicate your acceptance of the Tour Operator’s Privacy Policy.

If any provision of these Terms is so broad as to be unenforceable, such provision will be interpreted to be only so broad as is enforceable. The invalidity or unenforceability of any provision hereof will in no way affect the validity or enforceability of any other provision.

The Contract and these Terms are subject to the laws of Kenya and you submit to the exclusive jurisdiction of the courts located in Kenya for the resolution of any dispute under these Terms or concerning any Tour, product or service.
